Draft, awaiting legal review

This text is a working draft that has not been reviewed by a lawyer and is not binding. The approved wording will replace it before sales open.

Terms of service

Last updated

This draft describes how we imagine the terms. A lawyer will fill in the details in square brackets together with the operator.

1. Who provides the service

DameDoklad is operated by [company name, ID number, registered office, registry entry] (the “operator”).

2. What the service is

DameDoklad is a web application for keeping accounting, tax records and related areas. The user keeps their own data in it.

3. Accounts and companies

An account is required. The user is responsible for the accuracy of their details and for the security of their sign-in and API keys. They give other people access by assigning roles.

4. Responsibility for accounting and taxes

The application is a tool. The user is responsible for the accuracy of accounting, tax returns and reports and for filing them on time. The application creates files for filing, such as XML for the EPO portal, but does not send them to the Financial Administration itself. The application does not replace a tax advisor or an accountant.

5. Plans and payments

Prices and the scope of plans are on the pricing page. [To add: billing period, due dates, price changes, refunds, consequences of non-payment.]

6. Data and export

Data belongs to the user. The user can export it at any time. After an account is closed, data will be kept for [period to add] and then deleted, unless the law requires otherwise. The user is responsible for archiving accounting records for the legally required period.

7. Availability and changes to the service

[To add: scope of availability, planned maintenance, feature changes and how they are announced.] The operator does not currently publish an uptime guarantee.

8. Limitation of liability

[To add according to Czech law, including the extent of damages.]

9. Governing law

The relationship is governed by the law of the Czech Republic. [To add: disputes, consumers, out-of-court dispute resolution.]

10. Changes to the terms

[To add the process and notice period for changes.]
